BRAD E. SEIDEL

Of Counsel

Brad Seidel is a business trial attorney at Hedrick Kring Bailey PLLC, focused on complex commercial and consumer litigation. Clients routinely retain him for his tenacity and ability to creatively resolve issues. He has represented a broad array of clients from pension funds to individuals in state and federal courts across the country against some of the nation’s largest law firms. His experience includes litigating claims of breach of contract, breach of fiduciary duty, shareholder oppression, securities fraud, common law fraud, negligent misrepresentation, unfair and deceptive practices, royalty underpayment, and patent infringement. Outside of the courtroom, Mr. Seidel routinely advises executives and boards on risk management, contractual matters, dispute resolution, and litigation strategies and provides outside general counsel services.

Mr. Seidel has been recognized by Texas Super Lawyers as a “Rising Star” and “Super Lawyer,” with him most recently being named a “Super Lawyer” in 2021.  Mr. Seidel is also a member of the State Bar of Texas and the American Bar Association.  

Before joining Hedrick Kring Bailey PLLC, Mr. Seidel founded and ran his own law firm, Seidel Law Firm, PC.  Prior to that, he was a partner at Nix Patterson, LLP, a member at Potter Minton, PC, and counsel at Vinson & Elkins, LLP.  He began his career as a law clerk to the Honorable Sidney A. Fitzwater of the United States District Court for the Northern District of Texas in Dallas.  While in law school, he served as a judicial intern to the Honorable Nathan Hecht of the Texas Supreme Court.

He is admitted to practice in all state courts in Texas and Arkansas, the United States District Courts for the Northern, Eastern, and Western Districts of Texas, the United States District Courts for the Eastern and Western Districts of Arkansas, and the United States Courts of Appeals for the Fifth, Eighth, and Federal Circuits.

Mr. Seidel is an active member of the Austin civic community.  Currently, Mr. Seidel serves as a board member of Mariposa Family Learning Center, a non-profit child care and education center focused on a two-generation approach to serving preschoolers in an economically disadvantaged area of Austin.  

Representative Experience

  • Successfully achieved a series of settlements in a nationwide class action lawsuit against dozens of property insurance companies for failure to pay overhead and profit which provided class benefits in excess of $1 billion.
  • Successfully settled a nationwide class action lawsuit against hundreds of automobile insurance companies and a software developer for underpayment of uninsured and underinsured motorists claims which settlements provided class benefits in excess of $1 billion.
  • Successfully represented a state insurance fund and class of similar investors against a major Wall Street bank in a class action lawsuit alleging negligence, gross negligence, willful misconduct, and breach of fiduciary and contractual obligations over certain investment decisions, achieving a $280 million settlement for the class.
  • Successfully resolved a class action lawsuit for a pension fund and class of similar investors against a major Wall Street bank alleging negligence, gross negligence, and breach of fiduciary and contractual obligations over certain investment decisions, achieving a $150 million settlement for the class.
  • Successfully certified and then settled a royalty underpayment class action for a class of royalty owners against a major oil and gas producer, with the settlement providing $28 million in cash benefits to the class.
  • Served as a member of the Plaintiffs’ Executive Committee and Plaintiffs’ Steering Committee in multidistrict litigations concerning pharmaceutical products.
  • Member of a trial team that secured a $41 million judgment for patent infringement.
  • Member of a trial team that secured multiple verdicts of patent infringement in liability trial (damage trial still pending).
  • Successfully represented clients in achieving pre-suit resolution of royalty underpayments against two major oil and gas producers.
  • Successfully represented a minority partner in a lawsuit over a partnership dispute that concluded with a multi-million settlement.
  • Routinely provide outside counsel services to private companies and family offices regarding general contractual matters, negotiations, risk management, dispute resolution, and litigation strategies.

Educational Background

Mr. Seidel graduated with Highest Honors from the University of Texas School of Law (J.D. 1998), where he was a member of the Order of the Coif, served on the Texas Law Review, and was inducted into the Chancellors high honorary legal order.  He received his undergraduate degree in Agricultural Economics summa cum laude from Texas A&M University (B.S. 1995).
